The reason fracking is still legal is because a certain loophole called the “Halliburton loophole” from 2005. This loophole exempts fracking from being regulated by the Clean Water Act and the EPA. Companies don’t have to report what chemicals they use and how bad fracking is.
Some states, and areas in states, have imposed their own moratoriums.
However, there is a bill being proposed, the FRAC Act, that will make sure that the companies will be regulated by the EPA. Enclosed is a petition you can sign, if you want.
