In one study, the EPA stated “that the injection of hydraulic fracturing fluids into coal-bed methane (CBM) wells poses minimal threat to underground sources of drinking water (USDWs).” Additionally, the EPA found no confirmed cases of drinking water incidents or contamination that related back to hydraulic fracturing. While fracking is exempt from the Safe Water Act, the Underground Injection Control program still regulates the use of diesel fuel during hydraulic fracturing. Service companies must receive prior authorization from UIC before commencing with the fracking process of using diesel fuel.
