The cap is the most important part. The trade could be replaced by a penalty paid to the government to keep everyone under the cap. However, the trade is important in that it provides an incentive for countries to *further* reduce their emissions below the cap because it will allow them to trade their unused carbon allowances for money. That would not be the case with only a cap, but still the cap is the most important part.
