You should report it to your police or animal cruelty line in your location. Even if you are just guessing please don’t take chances. Animal cruelty is disgusting.
The punishments for animal cruelty depend on the state and the severity of the crime. The ASPCA recommends contacting the agency responsible for investigating animal cruelty in your state (A list is available here: http://www.aspca.org/fight-animal-cruelty/advocacy-center/state-animal-cruelty-laws/), since they themselves aren’t able to investigate racing issues. If you can’t find the agency, your state’s governor’s office should be able to direct you to it.
You can also contact the state racing or wagering bureau. For example, the New York Racing Association in New York State has a division dedicated to investigating cruelty to racehorses.
