    An air penalty is usually in the from of a fine after it has been through court.  If the EPA finds that a company or set of people are polluting illegally, they can register a complaint which usually results in a fine for large amounts of money.  When the EPA files a complaint, it gets taken to federal court.  There they are usually forced to pay a large fine for their failure to adhere to the law.

    An EPA air penalty refers to a monetary punishment (fine) for companies or groups that pollute illegally.  The EPA can take the company or group to federal court.
