If Congress fails to pass a climate bill can the EPA regulate emissions on its own?

    As a result of a 2007 Supreme Court ruling, the EPA is allowed to regulate CO2 emissions under the Clean Air Act. This would be a very difficult action to take, due to its prevalence throughout all industries, however. It is likely to be more efficient, and less scary for polluters, for Congress to regulate emissions through a climate bill. This is one of the bargaining chips that is used by the Administration to try to convince Congress to pass a comprehensive climate bill.
