It would be very hard to jail an individual responsible for the deaths caused by pollution. For common citizens to be jailed, there would have to be data showing that one person is able to cause enough pollution to kill other people (things like second hand smoking might but the data to show one person doing it to another would be almost impossible). As for companies dealing with pollution causing deaths, they are usually fined (like Cummins for Clean Air Act violations) or reach a settlement (like PGE did with the people of Hinkley, California – Erin Brockovich).
