Do you mean the lawsuit filed by activist group Public Citizen against the Texas Commission on Environmental Quality (TECQ)? That suit was filed in October 2009 to force the state to regulate greenhouse gases. It doesn’t seem like the case has been decided yet but in December 2009 the EPA decided to regulate greenhouse gases as air pollutants. Now Texas governor Rick Perry is suing the EPA on behalf of the state of Texas. He cites the “climate-gate” emails as proof that the EPA used “tainted data” to reach its decision. A similar lawsuit has been filed in Virginia.
