Yes you can, and in fact, you don’t even need to have an alcoholic beverage in hand to be cited for cycling under the influence in Oregon, California, Kansas or Delaware. In other states, the laws vary regarding the actual consumption of drinking while riding – though it is conceivably very difficult to do both things at once. Even if it is against the law, it is certainly unsafe to the rider and anyone he or she may come across while on their bicycle.
If you are stopped with an alcoholic beverage while riding a bicycle in California you could be cited for having an open container. If the officer decides to administer a field sobriety test and fail it, you could also be charged with a DUI and be arrested.
