The great (and terrible) thing about living in the US is that we can sue for anything at all. However, your chances of actually having a case that will be discussed in court are extremely low, given the current lack of laws restricting emissions. We’ll see what happens to the legal situation once a climate bill is passed. There is some precedent on this; I encourage you to check the citations. However, these are not cases of suing an individual company; rather, it is suing an environmental agency or a utility.
