U.S. law currently says that only people can be charged with murder, so no, a polluting company could not. But an individual resident of an area that has been polluted by a specific company could sue the company for damages, whether there were deaths or not, or the individual could talk to local authorities, like the state attorney general, to promote a lawsuit from the state.
With the legislation we have in place right now, the government regulates factory emissions and levies fines as punishment for companies that break these laws. The government does not issue criminal charges for excessive pollution.
